CLARIFICATION TEXT ON THE PROCESSING OF PERSONAL DATA IN THE PROVISION OF HEALTH SERVICES 

 

1. Identity of the Data Controller

As Kemer Medical Centre Özel Sağlık Hizmetleri Turizm ve Ticaret AŞ ("Özel Anatolia Hospital"), we process the personal data of the persons concerned and their relatives in the Hospitals where we provide health services as data controller by taking the necessary technical and administrative measures. Relevant persons can benefit from the explanations in this clarification text about their personal data processed during this process.

2. Purpose of Processing Personal Data and Legal Grounds for Processing

Personal data of patients and their relatives are prosessed for the purpose of

Ensuring Operational Security: To carry out operational processes in health services and to ensure operational security, in the capacity of an authorised health institution in terms of special categories of personal data, provided that the rights of the parties are protected and the contracts regarding the provision of health services can be fulfilled,

 

Ensuring Compliance with Legal Legislation: To carry out the operations in accordance with the legislation of the Ministry of Health and other relevant legislation and to provide information to authorised persons, institutions and organisations.

 

Collection of Health Service Fee: To execute the contract for the purpose of carrying out financial and accounting activities and follow-up of legal affairs in the processes of collection of the health service fee, provided that it is clearly stipulated in the laws and in the capacity of an authorised health institution in terms of special quality personal data, the right is protected and used in the processes of collection of the health service fee on the condition that the explicit consent of the person concerned is obtained in the transfer of health data to insurance companies. 

 

Informing and Promoting Current Diagnosis and Treatment Methods: To send messages for promotion, information and communication purposes, provided that the explicit consent of the patient and his/her relatives is obtained,

 

Emergency Management:  In case of emergency, information about your general health status is processed on the condition that your explicit consent is obtained.

 

3. To whom and for what purpose personal data may be transferred

Ensuring Compliance with Legal Legislation Personal data of patients and their relatives are transferred to the Ministry of Health, Social Security Institution, Provincial Health Directorate and other authorised public institutions and organisations in order to provide information and to carry out financial and accounting activities. To carry out financial and accounting activities, personal data of patients and their relatives are also shared with banks in the process of creating payment plans and with the certified public accountant from whom external services are received in accounting processes. 

 

Collection of Health Service Fee The personal data requested by the insurance company, including the health data of patients who wish to benefit from private health insurance, are shared with the relevant insurance company to carry out the collection process and to carry out financial and accounting activities. The Insurance Company that the patient benefits from may request images related to the procedure performed (such as surgery images). These images, which are not routinely taken in the provision of health services, may be recorded at the request of the relevant Insurance Company and with the consent of the Patient and transferred to the authorised Insurance Company on CD. We remind you that we are not the decision-maker in the process of taking these records, that we destroy the images at the end of a limited period of time and that you should apply to the Insurance Company from which you receive service for your claims on your images.

 

Informing and Promoting Current Diagnosis and Treatment Methods: Personal data of patients and their relatives are shared with contracted agencies and social platforms by obtaining explicit consent from these persons or upon their specific request, and are used in information documents prepared by the Hospital.

 

Emergency Management: In case of emergencies, travel companies, funeral companies, hotels and consulates with which the patient is affiliated are notified by minimising the personal data of the relevant patient and his/her relatives. 

 

Judicial and Official Audit Processes: Data is shared with lawyers to resolve legal disputes or to meet judicial requests. Data belonging to patients and their relatives are made accessible to auditors with whom a confidentiality agreement is concluded during audit processes.

 

4. Method of Personal Data Collection 

Data belonging to patients and their relatives are provided by these persons and processed in the patient registration systems of the Hospital staff. If you prefer to make an appointment, online interview, e-result, medication tracking functions on our website (www.anatoliahospital.com) and/or mobile application, your data will be provided through these channels. Paper forms, registration documents, policies, invoices, photocopies of identity cards are also used in the provision of health services. If patients and their relatives prefer to communicate with the hospital via e-mail, telephone, website and social media accounts used by Private Anatolia Hospital, personal data are recorded through these means.

 

5. Rights of Related Person 

Persons receiving health services at Private Anatolia Hospital and their relatives can always exercise their rights under Article 11 of the Law No. 6698 on the Protection of Personal Data. Persons receiving health services and their relatives should make sure that the contact information provided by Private Anatolia Hospital is up-to-date and accurate to be used both in the operation of their rights under Law No. 6698 and in other contractual and legal relations with Private Anatolia Hospital, we hereby inform you that Private Anatolia Hospital does not have a legal authority to check the accuracy of this information, and that Private Anatolia Hospital will not be responsible for the incorrect or incomplete declaration of contact information and not updating it in case of change .
